General terms and conditions

The General Terms and Conditions of Sale for the ELASTOMERI online store (https://elastomeri.si) govern the business and contractual relationship between the ELASTOMERI online store and visitors to the online store or customers. They have been compiled in accordance with the Consumer Protection Act, the Electronic Communications Act and the Personal Data Protection Act. The ELASTOMERI online store (hereinafter referred to as the online store) is owned and operated by the company Elastomeri d.o.o. Celje, Bežigrajska cesta 4, 3000 Celje, tax number: SI56652046 (also referred to as “ELASTOMERI” in these general terms and conditions). All orders, purchases and other services ordered through the online store are subject exclusively to the General Terms and Conditions of Sale for the ELASTOMERI online store (hereinafter also referred to as the “General Terms and Conditions”).

You can select, print and save the general terms and conditions for the online store as a PDF at any time. They are located at the bottom of the website.

Prices

All product prices in the online store are listed in euros (EUR) and do not include value added tax (VAT). Prices displayed on the website https://shop.elastomeri.si are subject to change without prior notice. Prices are valid at the time of order placement and have no predetermined validity.

In the event that the price of an item changes during the processing of the order, the provider undertakes to try to find a solution that satisfies both parties. Otherwise, the provider will allow the buyer to withdraw from the purchase.

Login or registration

You can purchase products in the online store as a guest (without a user account) or as a registered customer (with a user account), both hereinafter referred to as the “customer”. Both registered customers and guests of the online store must tick the box to agree to the general terms and conditions and the box to agree to the processing of personal data in order to make a successful purchase. This involves the processing of personal data for the purposes of providing services within the online store. To make a purchase in the online store, the customer must enter: name, surname, address, city, postal code, country, email address and contact telephone number (for companies, also the tax number). This information is required to complete the order. The customer must be at least eighteen years old to make a purchase.

Unregistered customers cannot take advantage of the benefits offered by registering on the website, such as:

  • easy reordering without re-entering data
  • possibility to check the status of open orders
  • possibility of viewing the archive of purchases and orders
  • redemption of gift certificates
  • redemption of credits for refund
  • payment according to the offer and issuing an invoice to the company
  • faster resolution of complaints
  • faster exchange of goods (within the framework of contractual rights)
  • changing the delivery address

The buyer is responsible for keeping his/her username and password safe. In case of suspicion that the security of his/her user account has been compromised, the buyer is obliged to change his/her password immediately. By entering his/her data during registration, the buyer guarantees that the entered data is correct.

Orders – purchase process

In the online store, a visitor can find the desired product in several ways:

  • You can search for a product using the navigation menu. Place the mouse cursor on the desired category in the menu and select the desired brand;
  • You can also search for a product using the search bar. Enter the name or keyword of the desired product in the box.
  • The visitor is then taken to a subpage with products of the selected brand. On the left side of the screen there is a filter for certain product attributes for easier searching (price range, dimensions, etc.). A product preview is possible – the product image is displayed (when the cursor is moved to the image, icons for quickly adding the product to the cart or wish list appear), the product name and the price. When clicking on the product image or name, the visitor is taken to the product subpage, where we find:
  • Product images (clicking on the image enlarges it). It is also indicated if the product is new and/or highlighted or has a discount.
  • product name and a link to the section where we can write an opinion about the product.
  • product price – may vary depending on the selected product variant (for example: the price of a product may vary depending on the material it is made of).
  • information about the product’s stock (if the product is out of stock, it is possible to send an inquiry by clicking “Send inquiry”. When the product is back in stock, the website visitor will be notified via email)
  • all product variants available
  • various options: add to wishlist, share product (email, social networks), product details, opinions of other customers.

On the right side there are boxes where the desired quantity of products is entered. The visitor adds the product or products to the cart by clicking on the “add to cart” button at the bottom of the section. When the visitor adds the product to the cart, a window with a preview of the cart appears. Thus, the visitor can, if he wishes, immediately complete the purchase by clicking on “Checkout”. If the visitor selects the “View cart” option, he will be redirected to a page that leads to the cart review and completion of the purchase. There, the customer is allowed to edit the cart (change the quantity and/or possibly remove products). After each change in quantities, the “update cart” button must be clicked. The visitor enters any discount code in the field provided for this, and confirms the code by clicking on “Apply discount”.

If the visitor wants to completely empty the cart, they should click on “Clear Cart”, if they want to add another product, they should select “Continue Shopping”. In the same place there is also a link to complete the order – “Proceed to Payment”, where the buyer enters their personal information for the order. Missing or incorrect content is displayed with a red frame and a warning for correction. The delivery method is also selected here.

Clicking the “Next” button takes the visitor to select a payment method:

  • payment with PayPal (click on the blue button with the inscription “Pay with PayPal”, a window will appear where you need to enter your PayPal account username and password);
  • by bank transfer or payment by pro forma invoice (after completing the order, the buyer receives an order confirmation and payment information via e-mail. The buyer enters the order number under the reference. The order must be paid for no later than three (3) days from the receipt of the e-mail with payment information. Otherwise, the company ELASTOMERI d.o.o. will cancel the buyer’s order. The deadline for preparing the order begins when ELASTOMERI d.o.o. receives the transfer to the current account.)
  • payment by direct debit from a credit card (Visa, MasterCard, Maestro, AmericanExpress);

Shopping with payment cards on the ELASTOMERI d.o.o. online store is completely safe. Measures are provided that are consistent with national and European legislation governing payment services. The measures are intended to reduce fraud in online payments.

Throughout the entire order completion process, the customer can see an “order summary”, which lists the products in the cart and their corresponding quantities, the total value of the order, and is also able to change the delivery address and delivery method.

The buyer completes their order by clicking the “Submit Order” button. When the buyer confirms the order, a notification appears stating that the purchase has been successfully completed, and then they receive an email with order details or confirmation of receipt of the order and an order tracking code.

The order is then reviewed and prepared by ELASTOMERI. The purchase agreement between ELASTOMERI and the buyer is concluded when the buyer receives an email with the notification “Your order is ready for shipment”. The confirmed order or purchase agreement is stored in electronic form on the ELASTOMERI d.o.o. server. The buyer can request a copy of the agreement by sending a request by email to info@elastomeri.si.

The buyer is bound by the general terms and conditions in force at the time of placing the online order or purchase. By placing the order, the buyer confirms his/her familiarity with the general terms and conditions.

Payment methods

Payment methods in the online store
The buyer can choose between the following payment methods:

  • Payment with PayPal – click on the blue button with the inscription “Pay with PayPal”, a window will appear where you need to enter your PayPal account username and password.
  • Payment by bank transfer or by pro forma invoice – after completing the order, the buyer receives an order confirmation and payment information via e-mail. The buyer enters the order number under the reference. The order must be paid for no later than three (3) days from the receipt of the e-mail with payment information. Otherwise, the company ELASTOMERI Ltd. will cancel the buyer’s order. The deadline for preparing the order begins when ELASTOMERI Ltd. receives the transfer to the current account.
  • Payment by direct debit from a credit card (Visa, MasterCard, Maestro, AmericanExpress).

Shopping with payment cards on the ELASTOMERI d.o.o. online store is completely safe. Measures are provided that comply with national and European legislation on payment services, which reduce the risk of fraud in online payments.

Payment method for orders placed directly with us
For orders placed directly with ELASTOMERI Ltd. (in person, by phone, by e-mail), the only payment method available is bank transfer.

After placing your order, you will receive an order confirmation and payment information by email. Please enter your order number as the reference.

Delivery

The company ELASTOMERI Ltd. strives for the fastest possible delivery of ordered goods within the territory of the Republic of Slovenia. Delivery is carried out in cooperation with Pošta Slovenije, DPD or GLS.

The delivery time is specified for each individual product separately and begins on the next business day after the order is confirmed. Saturdays, Sundays and holidays are not included in the delivery time. The company ELASTOMERI d.o.o. reserves the right to deliver partial shipments.

In the event that ELASTOMERI d.o.o. is unable to deliver the ordered products within the expected delivery time due to unforeseen circumstances (exceptional weather conditions, postal service delays, delays due to the effects of the infectious disease Covid-19, etc.), the buyer will be notified of this by email or telephone and offered a new delivery time. In this case, the buyer has the right to withdraw from the contract free of charge.

Discount code

Discount codes are time-limited and offer various benefits. They are published in various advertising messages, promotional emails, social networks and other media.

Codes can be tied to a specific product or to the entire purchase. When it is a code tied to a specific product, it is necessary to enter each code separately in the “discount code” field and confirm it. The calculated discounts are deducted from the final purchase amount. Only one code for the same product can be redeemed for each purchase.

The code cannot be exchanged for cash.

Receiving the shipment and suggested steps

When picking up the shipment, we suggest that the buyer take the following steps:

  • The buyer should check that the shipment is not damaged.
  • The buyer should check that they have received the product they ordered.
  • The buyer should carefully open the packaging and keep it in its original condition, not discarding the labels and protections until he is completely sure that he will keep the product.

If the buyer finds that the received shipment is damaged, he must initiate a complaint procedure. Within 30 days of receiving the goods, he must bring the product to the post office or arrange with the local postal unit to pick up the product at home and, together with the postal employee, make a report on the damaged shipment. For a faster solution, please send a copy of the report to info@elastomeri.si. Further handling of the damaged shipment is handled by the company ELASTOMERI d.o.o., which will send the buyer a new undamaged product or refund the purchase price.

If the buyer finds that the product received is not the product they ordered, they should not open the packaging, but contact ELASTOMERI d.o.o. at the email address info@elastomeri.si, where they will take over further resolution of the problem.

Withdrawal from the contract – return of goods

For contracts concluded through the online store, the buyer has the right to notify ELASTOMERI d.o.o. within 14 days of withdrawal from the contract (no reason is required). The only cost borne by the consumer in connection with withdrawal from the contract is the direct cost of returning the goods.

The buyer does not have the right to withdraw from contracts for goods:

  • which was manufactured according to the consumer’s precise instructions (tailored to their personal needs),
  • which, due to its nature, is not suitable for return,
  • which has visible traces of use or assembly of the product (dust, hair, scratches, stains, dirt – hygiene objection),
  • which is returned inseparably and mixed with other objects.

If the buyer has already received the goods and withdraws from the contract, the goods must be returned to the company undamaged and in the same quantity within 14 days of the company’s notification of his withdrawal. The buyer should return the goods or product in the original undamaged packaging to avoid reducing the refund. When returning the goods, the buyer should also include a copy of the original invoice and any other related documentation. The product packaging must be undamaged.

The buyer is liable for any diminished value of the product if the diminished value is the result of conduct that is not strictly necessary to establish the nature, properties and functioning of the goods.

The company ELASTOMERI d.o.o. will refund the payments no later than 14 days after receiving the withdrawal from the contract. The company ELASTOMERI d.o.o. reserves the right to withhold the refund of the payments received until the return of the goods has been received or until you provide proof that you have sent the goods back. The company will refund the received purchase price with the same payment method that the buyer used at the time of purchase, unless the buyer explicitly requested the use of another payment method.

The deadline for exercising the right to withdraw from the contract runs for the supply of goods from the day the buyer accepted the goods, and for the provision of services from the day the contract was concluded or the day the company fulfilled this obligation.

The buyer shall withdraw from the contract by sending an unambiguous statement of withdrawal from the contract via e-mail to info@elastomeri.si. The buyer shall be deemed to have submitted the withdrawal statement on time if it is sent within the deadline set for withdrawal from the contract.

Warranty

The product supplier guarantees the quality of the product’s manufacturing, but does not guarantee the speed of wear of the product, as this largely depends on the user.

Defects and forms of wear resulting from:

  • normal wear and tear,
  • careless handling of the product,
  • lack of maintenance,
  • defects that were known to the customer at the time of purchase.

The buyer must also enclose the purchase invoice to claim the warranty. The company ELASTOMERI Ltd. is responsible for resolving complaints, and must repair the goods within 45 days of receiving the request for correction of defects, otherwise the buyer will be provided with a new, flawless product.

If the manufacturer does not repair or replace the goods with a new one, the buyer can terminate the contract or request a reduction in the purchase price.

The warranty expires as soon as the buyer intervenes in the product with the intention of eliminating the defect. ELASTOMERI does not cover the costs of eliminating the defect if this is done by the buyer himself or by a third party without the consent of the company ELASTOMERI.

The buyer’s rights to enforce the warranty expire after two years from the date on which the buyer requested free repair of defects or replacement of the goods with new ones.

Complaints procedure

At ELASTOMERI Ltd., customer satisfaction is our top priority, so we are aware of the importance of complaints. The company strives to resolve them as quickly as possible and to mutual satisfaction, and in accordance with applicable legal provisions.

In the event of a material defect, the buyer may complain to the seller about a defect in the product within two months of discovering the material defect (the seller is no longer liable for defects that appear on the product after two years from receipt), and, at his own discretion, request the defect to be rectified or the amount paid to be refunded in proportion to the defect, or the replacement of the goods or the amount paid to be refunded. The consumer must describe the defect in more detail in the notification of the defect and allow the seller to inspect the product. If the defect is not disputed, the company must satisfy the consumer’s claim as soon as possible, but no later than within eight days. If there is a dispute about the defect, the company must provide the consumer with a written response within the same period.

In accordance with Article 37 of the Consumer Protection Act, a defect is material in the following cases:

  • if the product does not have the properties necessary for its normal use or for marketing
  • if the product does not have the properties necessary for the specific use for which the buyer is purchasing it, but which were known to the seller or should have been known to him
  • if the product does not have the properties and characteristics that were explicitly or tacitly agreed upon or prescribed
  • if the seller has delivered an item that does not match the sample or model, unless the sample or model was shown only for the purpose of notification

The suitability of products is assessed in relation to conventional products of the same type.

The buyer can claim a material defect by sending a notification to the email address info@elastomeri.si.
